Terms of Service

1. Agreement

By registering for or using any part of the BulkSMSRates.com platform (“Service”), you (“Customer”) agree to these Terms of Service (“Terms”) with BulkSMSRates.com Ltd (“we”, “us”). If you are acting on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Service Description

We provide a prepaid SMS platform accessible via HTTP API, SMPP v3.4, and a web dashboard. Destinations follow the published country list. China and Russia are not currently offered; that may change when a suitable route exists. Cuba and Iran stay suppressed. Some catalogue destinations are Coming Soon and are not sendable until they launch.

3. Account Registration

• You must provide accurate, current, and complete registration information.
• You are responsible for maintaining the confidentiality of your API credentials and for all activity that occurs under your account.
• You must be at least 18 years old and, if representing a company, duly authorised to enter into contracts on its behalf.
• We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a risk of fraud or abuse.

4. Acceptable Use

You must not use the Service to send:

• Unsolicited commercial messages to recipients who have not opted in to receive them.
• Content that is illegal, defamatory, harassing, threatening, or obscene under applicable law.
• Phishing, malware, or social engineering content.
• Messages to numbers on our or a carrier’s opt-out or do-not-call list.
• Messages to destinations we do not offer, destinations that stay suppressed, and any destination excluded from our published country list.

We enforce PECR (UK) and GDPR opt-out obligations. Violation of acceptable-use rules may result in immediate account suspension without refund.

5. Billing and Payment

• The Service operates on a prepaid wallet model. Credit is loaded before traffic is charged.
• Published purchase rails include GBP crypto credit packs and other checkout options shown in the dashboard when available. Options that are not available are simply not shown.
• All monetary amounts displayed are in GBP unless otherwise stated. Currency conversion estimates are indicative only. Public pack shelf prices are shown ex VAT. Checkout charges the gross amount (net plus VAT when the sale is in scope). Wallet credit is the net pack price plus any bonus.
• We do not offer refunds on purchased credits except where required by applicable consumer law or where we have materially failed to deliver the Service.
• We reserve the right to adjust pricing with 30 days’ notice. Existing wallet balances are unaffected.

6. Delivery

Delivery of messages is subject to carrier availability. We do not guarantee delivery for every destination or in every circumstance. We provide delivery-receipt data where the carrier supplies it.

7. Intellectual Property

All software, APIs, documentation, and branding associated with the Service are the exclusive property of BulkSMSRates.com Ltd. These Terms do not grant you any ownership interest. You retain ownership of the message content and contact data you provide; you grant us a limited licence to process that data solely to deliver the Service.

8. Confidentiality

Each party agrees to keep the other’s confidential information (including API credentials, pricing, and business data) confidential and not to disclose it to third parties without prior written consent, except as required by law.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from or related to the Service shall not exceed the amounts paid by you in the three months preceding the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or business interruption.

10. Indemnification

You agree to indemnify and hold harmless BulkSMSRates.com Ltd and its affiliates from any claims, damages, or costs (including legal fees) arising from your use of the Service in violation of these Terms or applicable law.

11. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and any unused wallet credit may be refunded at our discretion, less any processing fees. Sections 7, 8, 9, and 10 survive termination.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
